1. About these terms
These terms apply to all work done by Leichama Creative Studio ("Leichama", "we", "us") for you ("you", the client). When you send a brief, pay a deposit or approve a quote, you agree to these terms. If a written quote or proposal says something different, the quote applies for that project.
Nothing in these terms limits your rights under the Consumer Protection Act or any other South African law that can't be excluded.
2. Quotes and bookings
- Prices on our website are in South African rand. If VAT applies, it is shown on your invoice.
- Prices marked "from" depend on the size of the job. We confirm the final price in writing before we start.
- Quotes are valid for 14 days.
- Your booking is confirmed once we have your brief and your payment or deposit.
- Launch prices (for example, the R900 Mirror Ad for the first 10 clients) apply while the offer lasts and can't be combined with other discounts.
3. Payment
- Posters, gig guides and evidence portfolios: paid in full upfront.
- Videos, websites, kits and packs: 50% deposit to start. The balance is due before we send final, unwatermarked files or publish a website.
- Monthly plans: paid at the start of each month.
- We accept EFT. Please use your invoice number as the reference.
- If a balance is unpaid 14 days after the work is ready, we may pause the project. Drafts remain our property until paid in full.
4. Timelines
Our usual turnaround is 48 hours for posters, 3–5 working days for videos and 1–2 weeks for websites. Timelines start once we have your full brief, your files and your payment. If we wait on feedback, content or approvals from you, the timeline moves by the same amount. If you need work faster, ask us about our rush fee.
5. Changes and revisions
- Two rounds of changes are included in every price.
- Extra rounds, or new scenes added after the concept is approved, cost R250 each.
- A change in direction after approval (for example, a new concept, a different product or a new script) is treated as new work and quoted separately.
- Please send all changes for a round together, in one message.
6. Your content and permissions
When you send us photos, logos, music, videos, text, names or brand material, you confirm that:
- you own it, or have permission from the owner to use it for this project;
- any person shown in your photos or videos has agreed to appear in your marketing, and a parent or guardian has agreed for anyone under 18;
- it doesn't break anyone else's copyright, trade mark or privacy rights; and
- the claims you ask us to make about your business, products or prices are true.
You're responsible for the material you supply. If someone makes a claim against us because of material you supplied or claims you asked us to make, you agree to cover our reasonable costs. We may decline any content that we believe is unlawful, misleading or harmful.
7. Music
- Artists and DJs: send your own track, or one you have permission to use. You're responsible for clearing samples in your music.
- Businesses: we use royalty-free or properly licensed music, or deliver the video without music so you can add a sound from Instagram, TikTok or Facebook's own library, which is licensed for use inside those apps.
- We don't add commercial chart music to business ads, because platforms can mute or remove them.
8. AI-assisted work
We use AI tools for some scenes, backgrounds, drafts and edits. Every piece is then written, designed, edited and checked by a person before you see it.
- We only create AI visuals of a real, identifiable person, or make a real person appear to speak, with that person's permission. If you ask for this, you confirm you have it.
- Some platforms may label AI-assisted content. That's their decision and outside our control.
- AI-generated material may occasionally look like existing work. We review everything to avoid this, but we can't guarantee that no similarity exists.
- When you tick the consent box on our form, you allow us to use the files you send in AI tools for your project only. We never use your files to train AI models, and we choose tools that don't claim ownership of your files.
9. Who owns the work
Once you've paid in full, you own the final files we deliver and may use them for your business or career in any way you like. Until then, the work remains ours.
- We keep ownership of drafts, unused concepts, working files, our templates and our methods. Editable source files are only included if your quote says so.
- Stock photos, fonts, music and other third-party material stay under their own licences. We use licences that cover your normal marketing use; extra uses (for example, merchandise or TV) may need an extra licence.
- Templates bought from us may be used by the buyer for their own projects. They may not be resold or shared as templates.
10. Showing your work
We may show finished work in our portfolio and on our social media, unless you ask us not to in writing before the project ends. We never share confidential information, unreleased material or private figures, and we'll wait for your release date before showing anything that hasn't been launched.
11. Websites and portfolios
- Your domain name should be registered in your name. If we register it for you, we transfer it to you on request once paid.
- Hosting, domain and third-party service fees are paid by you, unless your quote says otherwise.
- Updates after the site goes live are quoted separately (for example, R350 per evidence portfolio update).
- We aren't responsible for downtime or changes caused by hosting companies or other third-party services.
12. Monthly plans
Monthly plans (such as Stay Booked, monthly content and monthly LinkedIn) run month to month. Cancel with one month's written notice. Items not used in a month don't carry over, unless we caused the delay.
13. Cancellations and refunds
- If you cancel before we start work, we refund your payment in full.
- Once work has started, your deposit covers the work done and isn't refundable. If more work was done than the deposit covers, we'll invoice for the work completed.
- Upfront payments for posters and gig guides are refundable only if we haven't started the design.
- If we can't complete a project, we refund what you've paid for work not delivered.
14. Checking your proofs
Please check every draft carefully, especially names, dates, times, venues, prices, phone numbers and spelling. Once you approve a final file, we aren't responsible for mistakes in it. If we made a mistake that you didn't catch, we'll gladly fix it, but we can't cover reprinting or other costs.
15. Results
We design every piece to get attention and action, but we can't promise particular sales, bookings, views, followers, interviews or job offers. Results depend on many things outside our control, including your offer, your audience, your budget and platform algorithms.
16. Limits of our liability
As far as the law allows, our total liability for any project is limited to the amount you paid for that project. We aren't liable for indirect losses, such as lost profits or lost bookings, or for actions by social media platforms, such as removing content or restricting accounts.
17. Sample work
Unless we say otherwise, the businesses, people, venues and figures in our sample work are fictional or used with permission. Any resemblance to a real business with the same name is unintended.
18. The law that applies
These terms are governed by the laws of the Republic of South Africa. If something goes wrong, please tell us first at hello@leichamastudio.co.za and we'll try to sort it out within 10 working days. We may update these terms from time to time; the version on this page on the date you book is the one that applies.
